The Department of Homeland Security has initiated rulemaking to simplify eligibility requirements, offer more flexibility to both employers and foreign workers, and combat fraud and abuse within the programme. The H-1B visa programme is primarily used by the tech industry, with Amazon leading in approved petitions in FY 2021, followed by Google, IBM, and Microsoft, as reported by Fox Business, an American conservative business news channel and website publication. Advocates of the programme argue that it fills labour market gaps and efficiency and improve processes for employers and workers navigating the immigration system,” Homeland Security Secretary Alejandro Mayorkas said in a statement. “The BidenHarris Administration’s priority is to attract global talent, reduce undue burdens on employers, and prevent fraud and abuse in the immigration system,” Homeland Security Secretary said as reported by Fox Business. Canada pulls out Laxman 41 diplomats after India hardens stance New Delhi [India], October 22 (ANI): The Indian Army on Sunday paid tribute to Agniveer Gawate Akshay Laxman, an operator who lost his life in the service of duty amid the treacherous terrains of the Siachen glacier. The Indian Army’s Fire and Fury Corps offered its deepest condolences to the bereaved family. “Quartered in snow silent to remain, when the bugle calls, they shall rise and march again. All ranks of Fire and Fury Corps salute the supreme sacrifice of Agniveer (Operator) Gawate Akshay Laxman, in the line of duty, in the unforgiving heights of Siachen, and offer deepest condolences to the family,” the Fire and Fury Corps posted on X. The Indian Army in a message on social media post said it stands firm with the bereaved family in this hour of grief. “General Manoj Pande COAS and All Ranks of the Indian Army salute the supreme sacrifice of Agniveer (Operator) Gawate Akshay Laxman, in the line of duty, in the unforgiving heights of Siachen. Earlier in June, one Army jawan died while three soldiers sustained injuries in a fire accident in the Siachen glacier, as per the Army. An Army spokesperson said that Regiment Medical Officer Capt Anshuman Singh succumbed to serious burn injuries during the unfortunate incident. While three other personnel suffered smoke inhalation and seconddegree burns, the officials added Siachen Glacier is known as the highestaltitude battle site in the world and is situated near the Indo-Pak Line of Control. It is the largest glacier in India and the second-largest in the world. It is the highest battleground on earth. (ANI New Delhi, Oct 20 (ANI): Amid the diplomatic tensions, Canada pulled out its 41 diplomats and their 42 dependents on Oct 19. Canada took the decision after India threatened to strip diplomatic immunities from the envoys in New Delhi. Canadian FM Melanie Joly announced and confirmed the departure of Canadian diplomats from India. India suspended visa operations to Canada and called for a reduction in Canadian diplomats in New Delhi. Melanie Joly further added that diplomats and their dependents have now left diplomatic immunities. Canada will put a pause on all in-person services in its consulates in Chandigarh, Mumbai and Bangalore. Canadian PM Justin Trudeau recently alleged India’s involvement in killing of Khalistani Terrorist Hardeep Singh Nijjar. Trudeau, in Canadian Parliament, said that “agents of the Indian govt” carried out the killing of its citizen. However, New Delhi has outrightly rejected the claims and called it ‘absurd’ and ‘motivated’. One month passed, Canada is yet to provide evidence to support the ‘absurd’ claim against India. Nijjar, who was a designated terrorist in India, was gunned down in a parking area in Canada’s Surrey on June 18. India can expect overall delays in visa processing: Canada Immigration authority amid standoff Immigration, Refugees and Citizenship Canada (IRCC) on Thursday said that there would be a slowdown of Indian visa applications after Canada removed its 41 diplomats from India amid the ongoing India- Canada standoff. In a press statement from IRCC said, “Following India’s intent to unilaterally remove immunities for all but 21 Canadian diplomats and dependents in Delhi by October 20, 2023, Immigration, Refugees and Citizenship Canada (IRCC) is reducing its number of employees in India from 27 to 5. IRCC will continue to accept and process applications from India, but reduced staffing levels are expected to impact processing times.” Moreover, the statement said that due to the decrease in Canadian diplomatic staff in India, Indian citizens would face delays in overall processing times, responses to enquiries and getting visas or their passports back. Meanwhile, the Canadian authorities have assured that the Canadabased IRCC staff in India will do the day-to-day work required in the country. Quoting the statement, “The large majority of applications from India are already processed outside the country, with 89% of India’s applications processed through the global network. The 5 Canada-based IRCC staff who remain in India will focus on work that requires an in-country presence such as urgent processing, visa printing, risk assessment and overseeing key partners.”

October 27, 2023 Friday INDIA THIS WEEK Biological father is liable to maintain his child, says Delhi High Court New Delhi [India], October 25 (ANI): The Delhi High Court recently upheld the trial court orders denying maintenance to a child who was born after one month of the marriage of the parties. The high court took note of the DNA report which stated that husband of the petitioner is not biological father of her child. Justice Swarana Kanta Sharma said, “In face of DNA report existing on record, respondent (husband) cannot be held liable to make payment of maintenance to the child, even though the child was born during the subsistence of marriage between the petitioner and respondent. In this regard, the law is also settled that the biological father is liable to maintain his child, said Justice Sharma. The bench also took note of the arguments of counsel for respondent that he was a minor at the time of marriage. Therefore, the marriage itself is void. It was also argued that the petitioner wife concealed the fact of her earning from the court. The high court said, “This Court is of the opinion that at the stage of grant of interim maintenance, a prima-facie view of the facts placed before the Court had to be taken, along-with the affidavit of income and expenditure filed before it by the parties concerned, as per settled law. The factors for deciding the grant of maintenance are also settled in this regard. The high court said that in this case, even if it is the case of the petitioner that she was working as a cook or domestic help and was earning earlier, at present, there is nothing on record to reveal that she is earning anything or is working anywhere. “Since the factum of marriage between the parties is not disputed though validity thereof is disputed, which is subject matter of adjudication before the concerned court of law, this Court is of the opinion that the learned Trial Court has committed an error by denying maintenance to the petitioner herein since at this stage, it is apparent from the record that she is not working or earning,” Justice Sharma pointed out. It was the petitioner that she used to work as domestic help/work at the house of respondents for three years from February 2013 to February 2016. She alleged that during this period, respondent had made sexual advances towards the petitioner and had sexual intercourse on regular basis with the petitioner on the pretext of promise to marry her. As alleged, respondent had also compelled the petitioner twice to have sexual intercourse with two of his friends also and when the petitioner had refused to do so, respondent had threatened not to marry her in case she will not maintain physical relations with his two friends and, due to such threats, she had performed involuntary sexual intercourse with the said two friends of respondent on two occasions in the aforesaid period of three years. Under this mission,’ RPF has rescued 895 children, including 573 boys and 322 girls, who were in need of care and protection, read the Ministry of Railways press release. The children were reunited with the concerned authorities and subsequently sent to their families. This operation has played a pivotal role in reuniting children who were separated from their families due to various reasons. Notably, the fight against human trafficking has always been a matter of concern for the Railway authorities. Anti-Human Trafficking Units (AHTUs) operate at the post level (Thana level) across the Indian Railways. In September 2023, these units were instrumental in the rescue of 29 individuals from the clutches of traffickers, leading to the arrest of 14 traffickers, the press release said. The release said that 265 passengers who were saved by the police were at risk of being run over by trains on platforms and railway tracks. The feat was achieved under ‘Operation Jeevan Raksha,’ which focuses on ensuring the safety of passengers in distress. For the security and well-being of women passengers, the RPF has launched “Meri Saheli,” an initiative aimed at providing security to lady passengers, particularly those travelling alone or those who are vulnerable to crime, read the press release. He also expressed solidarity with Israel in its fight against the terrorist group Hamas. HinduACTion and Namaste Shalom Multifaith Alliance organised a timely Congressional briefing on Tuesday in support of Israel and against rising anti-Hindu bigotry and antisemitism in the US and Canada. “India is the only country in the world with no history of antisemitism. Ravindra, India‘s Deputy Permanent Representative (DPR) to the United Nations, on Wednesday, underlined New Delhi’s efforts to send humanitarian assistance to civilians in the Gaza Strip, amid the ongoing Israel–Hamas war, saying that it has sent 38 tons of food and critical medical equipment to the region. Ravindra made the statement while representing India at the United Nations Security Council Open-debate on the “situation in the Middle East, including the Palestinian question”. Thanking the United Nations General Assembly (UNGA) for the open debate on the latest chapter of hostilities in West Asia, he said India was deeply concerned about the deteriorating security situation and largescale loss of civilians in the ongoing conflict. “The mounting humanitarian crisis is equally alarming,” he said. “India has sent 38 tons of humanitarian goods, including medicines and equipment, to the people of Palestine. We also urge the parties to work towards creating conditions necessary for peace and for restarting direct negotiations, including through de-escalation and issuing violence,” Ravindra added. “The escalation of our utilities in the region has only exacerbated the dire humanitarian situation,” he said, adding, “It has once again underscored the fragile nature of the ceasefire.” The terror attacks that happened on October 7 in Israel were shocking and India condemned them unequivocally, the deputy permanent envoy to the UN noted. Prime Minister Narendra Modi was one of the first global leaders to convey his condolences over the loss of lives and “prayers for the innocent victims and their families”. “We stood in solidarity with Israel at their moment of crisis when they were facing these terror attacks,” Ravindra added. “We have also expressed deep shock at the tragic loss of lives at the Al Hali hospital in Gaza, where several hundreds of civilian casualties have occurred and thousands injured. Our heartfelt condolences to the families of the victims and prayers for the speedy recovery of the injured,” India‘s deputy permanent envoy to the world body added. PM Modi had also said those involved in the attack “must be held responsible”, Ravindra added, noting that the civilian casualties in the ongoing conflict are a matter of serious and continuing concern. All parties must protect civilians, especially women and children. “The Unfolding humanitarian crisis needs to be addressed. We welcome the efforts of the international community for de-escalation and delivery of humanitarian goods to the people of Gaza,” he added. Also reaffirming India‘s support for a two-state solution to the Israel–Palestine issue, he said the same can lead to the establishment of a sovereign, independent and viable state of Palestine, living within secure and recognized borders, side by side in peace with Israel, taking into account the legitimate security concerns of Israel. “Towards this, we reiterate the need for an early resumption of direct peace negotiations. We also continue to support the Palestinian people through our bilateral development partnership, which covers a wide range of sectors including health, education, women’s empowerment, entrepreneurship and information technology,” 9 Ravindra said. He added India was also supporting grassroots Palestinian institutions in their development initiatives. “In these challenging times, India will continue to send humanitarian assistance to the people of Palestine,” India‘s deputy permanent envoy to the UN said. He stated that the current escalation of the conflict has once again underscored the need for immediate resumption of credible, direct negotiations between Israel and Palestine. “Every effort must be made to create conducive conditions for the resumption of these talks. We welcome all efforts of regional and global players aimed towards restoring normalcy,” he said.
