Justice Ravindra Bhat, Justice Hima Kohli and Justice PV Narasimha have given two separate judgments whereby they have shown certain agreement and disagreement with CJI’s order. There were four judgements separately authored by the CJI and Justices Kaul, Bhat and Narasimha. While CJI and Justice Kaul have the same opinion, Justices Bhat, Narasimha and Kohli have agreed with each other. The majority judges by 3:2 held that non-heterosexual couples cannot be granted the right to jointly adopt a child. However, CJI and Justice Kaul said that these couples have the right to jointly adopt a child. Justice Bhat, in its order, said, “Regulation 5(3) of the CARA Regulations cannot be held void on the grounds urged.” Justice Bhat disagrees with the CJI’s opinion of allowing non-heterosexual couples to jointly adopt. “At the same time, this court is of the considered opinion that CARA and the Central Government should appropriately consider the realities of de facto families, where single individuals are permitted to adopt and thereafter start living in a non-matrimonial relationship. In an unforeseen eventuality, the adopted child in question could face exclusion from the benefits otherwise available to adopted children of married couples. This aspect needs further consideration, for which the court is not the appropriate forum,” Justice Bhat said. October 20, 2023 Friday INDIA THIS WEEK SC averse to directing doctors to stop unborn’s heartbeat, turns down plea for medical termination of pregnancy ` New Delhi [India], October 16 (ANI): The Supreme Court on Monday said that it is averse to issuing a direction to doctors to stop the unborn’s heartbeat while allowing the Centre’s application to recall its earlier order to allow termination of pregnancy. A bench of Chief Justice of India DY Chandrachud, also comprising Justice JB Pardiwala, observed that if a medical termination were to be conducted at this stage, the doctors would be faced with a viable foetus. “One of the options before this Court, which the email from AIIMS has flagged, is for it to direct the doctors to stop the heartbeat. This Court is averse to issuing a direction of this nature for the reasons recorded in the preceding paragraph. The petitioner, too, did not wish for this Court to issue such a direction. This was communicated by her to the court during the course of the hearing,” the court said. “This Court is averse to issuing a direction of this nature for the reasons recorded in the preceding paragraph,” the court said. “In the absence of a direction to stop the heartbeat, the viable foetus would be faced with a significant risk of lifelong physical and mental disabilities. The reports submitted by the Medical Board speak for themselves,” the court said. “For these reasons, we do not accede to the prayer for the medical termination of the pregnancy,” the court said. The court directed that the delivery will be conducted by AIIMS at the appropriate time. The Union Government has undertaken to pay all the medical costs for the delivery and any incidental costs. The court said that the decision of whether to give the child up for adoption is entirely that of the parents. The court noted that the length of the pregnancy has crossed twenty-four weeks, and it is now approximately twenty-six weeks and five days. The court said that a medical termination of the pregnancy cannot be permitted because it has crossed the statutory limit of twenty-four weeks. The requirements in either Section 3(2B) or Section 5 must be met. “There are no “substantial foetal abnormalities” diagnosed by a medical board in this case, in terms of Section 3(2B). This Court called for a second medical report from AIIMS to ensure that the facts of the case were accurately placed before it and no foetal abnormality was detected,” the court noted. Neither of the two reports submitted by the medical boards indicates that a termination is immediately necessary to save the life of the petitioner, in terms of Section 5 of the MTP Act. The court rejected a woman’s plea, seeking medical termination of 26 weeks of pregnancy and observing if it is allowed the it would violate the provisions under the Medical Termination of Pregnancy (MTP) Act. All India Institute of Medical Science (AIIMS) on Monday apprised the Supreme Court that no abnormality has been detected in the foetus of a woman who had petitioned to seek the medical termination of her 26-week pregnancy and that with proper care and treatment under appropriate medical supervision, the mother and baby can be managed well during pregnancy and postpartum psychosis. “It is felt that with proper care and treatment under appropriate medical supervision, the mother and baby can be managed well during pregnancy and postpartum, as has been previously evidenced by her response to medications. In case of worsening of symptoms, she may be admitted and treated,” the AIIMS report said. The hospital’s report was filed after the apex court directed it to do so in an order on October 13. The woman has sought the termination of her 26week pregnancy, whereas the Centre has filed an application seeking a recall of the top court’s order by which the woman’s petition has been allowed. Additional Solicitor General Aishwarya Bhati submitted the AIIMS report, which stated that the woman has a past history of postpartum psychosis and is currently Hyderabad (Telangana) [India], October 17 (ANI): As the poll bugle sounds in Telangana, the Congress is considering including a promise in its manifesto for the upcoming Telangana polls. This promise, under the proposed ‘Mahalakshmi’ guarantee, may offer eligible women 10 grams of gold at the time of their marriage, according to party leaders. “Discussions regarding this proposal are ongoing with senior party leaders. In addition to the existing commitment of providing Rs 1 lakh to the bride’s family through the ‘Mahalakshmi’ guarantee, the party is contemplating adding the provision of gold,” Sridhar Babu, the chairman of the Telangana Congress manifesto committee said. “However, this recommendation is not final yet, and its confirmation will depend on the Pradesh Congress Committee (PCC) and the All India Congress Committee (AICC),” he said. Congress earlier tabled the ‘Mahalakshmi’ scheme which will guarantee Rs 2,500 per month for women, an LPG cylinder at Rs 500 and free bus travel for women in Telangana State Road Transport Corporation (TSTRC). With the announcement of the ‘Mahalakshmi’ guarantee scheme, the grand old party is trying to woo women voters. According to the data, the total number of voters in Telangana state stands at 3,06,42,333, wherein 1,53,73,066 are male voters and 1,52,51,797 are female voters, the rest of the voters belong to the third gender. At present, the Bharat Rashtra Samiti (BRS) government led by Chief Minister K Chandrashekhar Rao, offers the ‘Kalyan Lakshmi’ scheme. As per an official statement, the main objective of the Kalyana Lakshmi scheme is to provide financial assistance to new wedding brides who belong to SC, ST and minority families. Under this scheme at the time of marriage of the bride financial aid will be transferred into the bank account of the mother. The Telangana Assembly polls are scheduled to be held on November 30 and the counting of votes will take place on December 3. Telangana is set to witness a triangular contest between the BJP, the ruling Bharat Rashtra Samithi, and the Congress in the upcoming assembly election. In the previous Assembly election held in 2018, BRS managed to win 88 seats out of 119 and had a dominant vote share of 47.4 per cent. Congress came in a distant second with 19 seats. The court also took note of the AIIMS report. ASG Bhati, appearing for the Centre, apprised the court about the Medical Termination of Pregnancy Act and said that it is a liberal and prochoice legislation aimed at giving absolute primacy to the reproductive autonomy and health of the woman while balancing the rights of a viable unborn child. She further added that now it is not a matter of choice but a choice between preterm delivery and full-term delivery. She assured the court that the government would assist her and her husband with everything, including medical counselling. Senior Advocate Colin Gonsalves apprised the court on the issue related to the unborn and said that in international law today, there is no right to the unborn child, and the right of the woman is absolute. But the court remarked with a question about whether the woman should be allowed to abort even at 33 weeks of pregnancy in those cases where the foetus is not abnormal. The court also said that the challenge to be law should be dealt with in some other proceedings, as now the matter is limited to the woman and the state. The matter was referred to a three-judge bench after a two-judge bench on October 11 gave a split order on the married woman’s plea seeking termination of a 26-week pregnancy. A two-judge bench of Justices Hima Kohli and BV Nagarathna gave the split decision while hearing the Centre’s plea seeking the recall of its earlier order allowing the woman to undergo the procedure of termination of her pregnancy. Justice Hima Kohli said that her judicial conscience does not allow her to permit termination. Expressing disagreement, Justice BV Nagarathna said that the woman’s decision to terminate her pregnancy must be respected. The woman has submitted an affidavit stating she does not wish to carry out her pregnancy due to her mental condition and ailments. On October 9, a bench of justices, Hima Kohli and BV Nagarathna, directed the woman to visit the Obstetrics and Gynaecology Department, AIIMS, New Delhi, on October 10. The court had also directed the AIIMS to admit the petitioner to undergo the procedure of termination of her pregnancy at the earliest, with follow-up as may be advised by the treating doctors. The indirect discriminatory impacts in relation to earned or compensatory benefits, or social welfare entitlements for which marital status is a relevant eligibility factor, for queer couples who in their exercise of choice form relationships, have to be suitably redressed and removed by the State. These measures need to be taken with expedition because inaction will result in injustice and unfairness with regard to the enjoyment of such benefits, available to all citizens who are entitled and covered by such laws, regulations or schemes (for instance, those relating to employment benefits: provident fund, gratuity, family pension, employee state insurance; medical insurance; material entitlements unconnected with matrimonial matters, but resulting in adverse impact upon queer couples). As held earlier, this court cannot within the judicial framework engage in this complex task; the State has to study the impact of these policies, and entitlements,” Justice Bhat. I am in complete agreement with the reasoning given and conclusions arrived at by Justice Bhat.” “The State may choose from a number of policy outcomes; they may make all marriage and family-related laws gender gender-neutral, or they may create a separate SMA-like statute in gender-neutral terms to give the queer community an avenue for marriage, they may pass an Act creating civil unions, or a domestic partnership legislation, among many other alternatives. Another consequence may be that rather than the Union Government, the State legislatures take action and enact law or frameworks, in the absence of a central law,” the order passed by Justices Bhat and Kohli said. “What is certain, however, is that in questions of such polycentric nature – whether social, or political – the court must exercise restraint and defer to the wisdom of the other branches of the State, which can undertake widescale public consultation, consensus building and reflect the will of the people, and be in their best interest. If as a result of this, a law is enacted that undermines or violates the constitutionally protected rights of an individual, or a group – no matter how miniscule, their right to seek redressal from this Court is guaranteed under Article 32,” the order copy read. According to one of the petitions, the couple sought to enforce the fundamental rights of LGBTQ+ individuals to marry any person of their choice and said that “the exercise of which ought to be insulated from the disdain of legislative and popular majorities.” for all followers of Dr. Ambedkar. With the arrest of Sanghamitra Kumbhare and Rosa Ramteke, the police have unravelled the mysterious death case of five persons of a family within a month, they said. As per the Superintendent of Police, Gadchiroli, Neelotpal, the two women poisoned five members of a family over an ancestral property dispute and other reasons. “In Village Mahagao, tehsil Aheri, in the Gadchiroli district, over the past few days, Shankar Piru Kumbhare, along with four members of his family, suddenly fell ill and died within a span of twenty days,” police said. “Firstly, on September 20, 2023, Shankar Kumbhare and his wife, Vijaya Kumbhare, were shifted to a hospital in Aheri, after the duo experienced a sudden deterioration in their health. They were later shifted to a reputed hospital in Nagpur for treatment. Unfortunately, due to a lack of proper diagnosis, Shankar Kumbhare passed away on September 26, 2023, followed by his wife, Vijaya Kumbhare on September 27,” Gadchiroli SP, Neelotpal said. He said that while still recovering from this shock, Kumbhare’s daughter, Komal Dahagaokar, and his son, Roshan Kumbhare, who were residing in Gadaheri, as well as his daughter Ananda, also known as Varsha Urade, who was living nearby, were hospitalized in different medical facilities. “Their conditions deteriorated day by day without any signs of improvement. Later, Komal passed away on October 8, Ananda (Varsha Urade) on October 14 and Roshan Kumbhare on October 15,” he added. The police said that apart from the deceased family members, they poisoned other three persons, including the Kumbhare’s eldest son and the driver who took Shankar and Vijaya to the hospital for treatment. “Their condition is stable now,” police added. Incidentally, the police took the matter seriously and an investigation was initiated. “Four different investigation teams were formed immediately, to conduct inquiries in various districts of Maharashtra and Telangana. Reliable sources later provided information that Sanghamitra Kumbhare, Shankar Kumbhare’s daughter-in-law and Rosa Ramteke, the wife of a brother-in-law of Shankar Kumbhare were actively involved in crime. Police closely monitored their activities and detained them on October 18, 2023. Subsequent investigations revealed that both the individuals had committed the crime,” police added. Relevant sections of the Indian Penal Code (IPC) have been registered against the arrested women and further details are awaited. (ANI) Jabalpur (Madhya Pradesh) [India], October 18 (ANI): A woman allegedly strangled her two-year-old niece to death for not allowing her to sleep in Madhya Pradesh’s Jabalpur, police said on Wednesday. The incident occurred in the Hanumantal police station limits and the accused has been arrested, officials said. Additional Superintendent of Police Priyanka Shukla Jabalpur said the victim, daughter of one Sakil Mansoori, went missing on Monday afternoon. The family members of the girl filed a missing person report, he said, adding that police recorded statements of relatives of the girl. Upon finding discrepancies in their statements, police searched the house and found the girl’s body under a sofa in the drawing room, SP Shukla added. After a detailed investigation, police interrogated, Afsana, the girl’s aunt. “She confessed to her crime and told the police that the girl had come to her room on Monday afternoon,” SP Shukla said. “I asked her to go out of my room and slapped her. She started to cry loudly. I covered her mouth and nose with my hand to silence her. Fearing her dead, I hide her body under the sofa,” the accused told police. The accused has been taken into custody, SP Shukla said, adding that they were waiting for a post-mortem report following which a case of murder will be registered against her. (ANI)

FRIDAY OCTOBER 20, 2023 9 Aditya-L1 to reach Lagrange Point 1 by mid-January: ISRO Chief S Somnath Madurai (Tamil Nadu) [India], October 15 (ANI): Indian Space and Research Organisation (ISRO) Chief S Somnath on Sunday said that India’s first solar mission, Aditya-L1 spacecraft will reach the Lagrange Point 1 (L1) by mid-January. “It is working very well... Currently, it takes almost 110 days to travel from Earth to the L1 point. So by the middle of January, it will reach the L1 point. Then at that point, we will do the insertion into the Lagrange Point. That is called the halo orbit. It’s a big orbit. So that will happen by the middle of January”, Somath told reporters in Tamil Nadu’s Madurai. It is worth mentioning that after the successful soft landing of Chandrayaan-3 near the South pole of the moon, the ISRO launched the country’s maiden solar mission — Aditya-L1 from the Satish Dhawan Space Centre in Sriharikota on September 2. It carried seven different payloads to have a detailed study of the sun, four of which will observe the light from the sun and the other three will measure in-situ parameters of the plasma and magnetic fields. Aditya-L1 will be placed in a halo orbit around Lagrangian Point 1 (or L1), which is 1.5 million km away from the Earth in the direction of the sun. It is expected to cover the distance in four months’ time. Aditya-L1 will stay approximately 1.5 million km away from Earth, directed towards the Sun, which is about 1 per cent of the Earth-Sun distance. The Sun is a giant sphere of gas and AdityaL1 would study the outer atmosphere of the Sun. ISRO had said Aditya-L1 will neither land on the Sun nor approach the Sun any closer. In addition, the ISRO Chief also spoke about the ‘Gaganyan‘ mission. “Test Vehicle-D1 mission is scheduled for October 21. This is the Gaganyaan program. The Gaganyaan program requires testing, demonstrating the crew escape system. The crew escape system is a very critical system in Gaganyaan. If anything happens to the rocket, you have to save the crew by moving the crew away from the exploding rocket at least by two km. So this test is to demonstrate the crew escape system in one condition of the flight. So this condition we are demonstrating is called the Transonic condition...”, Somnath said. ” Every month we will have at least one launch. After this test vehicle launch, we have GSLV. Then we have SSLV. Then after that, the Gaganyaan unmanned mission will be there. In between there will be a PSLV launch. So before January, you will see at least 4-5 launches”, he added. According to the ISRO, the Gaganyaan project envisages a demonstration of human spaceflight capability by launching a crew of three members to an orbit of 400 km for a three-day mission and bringing them back safely to earth, by landing in Indian sea waters.
