Proteas have once again left heartbroken, yet to win an ICC title. Meanwhile, India has ended its 11-year long ICC trophy drought, winning their first ICC title since the Champions Trophy in 2013. Hathras (Uttar Pradesh) [India], July 2 (ANI): Following the devastating stampede at a religious event in Hathras district of Uttar Pradesh that claimed at least 116 lives and left 18 others injured, Chief Minister Yogi Adityanath on Tuesday vowed a thorough investigation into the incident to determine whether it was an “accident or a conspiracy.” A l i g a r h Commissioner Chaitra V said, “116 people have been confirmed dead. 18 people are injured. Treatment is being ensured for the injured in Aligarh district. Primary investigation is being carried out.” Chief Minister Yogi Adityanath affirmed that the state government is committed to uncovering the truth behind the Hathras incident. “Doing politics instead of expressing condolences on such an incident is extremely unfortunate and condemnable. The Government of India and the state government have also announced a compensation of Rs 2 lakh each to the families of the deceased and Rs 50,000 each to the families of the seriously injured,” CM Yogi said. According to the reports shared by Sonali Ghosh, Field Director of Kaziranga National Park, the flood waters submerged 22 forest camps in the Agoratoli range, 10 in the Kaziranga range, 8 in the Bagori range, 5 in the Burapahar range, 6 in Bokakhat range, 10 in Biswanath Wildlife Division. The park authorities have taken measures for the safety and security of wild animals. To control the speed of vehicles on National Highway 37 which passes through the park, the authorities have already installed speed sensor cameras in different locations of the park area. Deployment of forest guards and staff on the national highway area has also been increased. Earlier Union Minister Sarbananda Sonowal took stock of the worsening flood situation in his constituency, Assam‘s Dibrugarh, on Sunday. Sonowal, in a post on X, said that he spoke to the Chief Secretary of Assam, District Collector Dibrugarh, MLA Prasanta Phukan, Mayor, Deputy Mayor, Ward Councillors and other officials and reviewed the situation in the region. “In view of the flood in Dibrugarh town, took stock of the conditions and directed officials to take immediate measures to mitigate the situation,” he said. The Union Minister was updated on various efforts undertaken by the government to minimise the impact of the floods on the way of life, according to a Ministry of Ports, Shipping and Waterways release. The death toll rose to 34 with deaths of two children in the Dhemaji district on Sunday. The officials of Assam State Disaster Management Authority (ASDMA) said, “Two children died after drowning in flood waters at Gogamukh and Jonai area in Dhemaji district on Sunday and the total death toll has mounted to 34 across the state so far.” The flood situation in Assam deteriorated after the flood waters submerged new areas and affected over 2.62 lakh people in 12 districts. According to the flood report of the Assam State Disaster Management Authority (ASDMA), 12 districts of the state– Kamrup, Karimganj, Tinsukia, Golaghat, Dhemaji, Majuli, Cachar, Lakhimpur, Dibrugarh, Sivasagar, Kokrajhar, Jorhat were affected by the second wave of flooding. INDIA THIS WEEK New criminal laws will replace IPC, CrPC, Indian Evidence Act from today July 5, 2024 Friday New Delhi [India], July 1 (ANI): In a move that will completely overhaul the criminal justice system in the country, three new criminal laws will come into effect from today, July 1. The Bharatiya Nyaya Sanhita (BNS), the Bharatiya Nagrik Suraksha Sanhita (BNSS), and the Bharatiya Sakshya Adhiniyam (BSA), passed in Parliament last December, will replace the Indian Penal Code (IPC), 1860, the Criminal Procedure Code (CrPC), 1973, and the Indian Evidence Act, 1872 respectively. Several new provisions have been incorporated in the three new criminal laws to suit contemporary times and technologies in vogue. The three new laws received Parliament’s nod on December 21, 2023. President Droupadi Murmu gave her assent on December 25, 2023, and was published in the official gazette on the same day. As per the notification, the three laws will focus on justice rather than punishment and are aimed at providing speedy justice, all the way, strengthening the judicial and court management system emphasising ‘access to justice by all’. Bharatiya Nyaya Sanhita will have 358 sections (instead of 511 sections in the IPC). A total of 20 new crimes have been added to the bill, and the imprisonment sentence has been increased for 33 of them. The amount of the fine has been increased in 83 crimes and mandatory minimum punishment has been introduced in 23 crimes. The penalty of community service has been introduced for six crimes and 19 sections have been repealed or removed from the bill. Bharatiya Nyaya Sanhita has introduced a new chapter titled ‘Crimes against Women and Children’ to deal with sexual crimes. Provisions related to the gang rape of a minor woman will become consistent with the Protection of Children from Sexual Offences Act (POCSO), and a provision has been made for life imprisonment or death penalty in the case of girls below 18 years of age. There is the provision of 20 years imprisonment or life imprisonment in all cases of gang rape and the new crime category of gang rape of a woman under 18 years of age in the Sanhita. The Sanhita provides targeted penalties for persons fraudulently engaging in sexual intercourse or promising to marry without true intention to marry. Terrorism has been defined for the first time in the Bharatiya Nyaya Sanhita, and it has been made a punishable offence. The new provisions include armed rebellion, subversive activities, separatist activities or any act threatening the sovereignty or unity and integrity of India. Small organized crimes have also been criminalized, punishable with imprisonment of up to seven years. Bharatiya Nagrik Suraksha Sanhita will have 531 sections (in place of 484 sections of CrPC). A total of 177 provisions have been changed in the bill, and nine new sections as well as 39 new subsections have been added to it. The draft act has added 44 new provisions and clarifications. Timelines have been added to 35 sections and audio-video provision has been added at 35 places. A total of 14 sections have been repealed and removed in the Sanhita. The timeline has been added to 35 sections of Bharatiya Nagrik Sukraksha Sanhita, which will make the speedy delivery of justice possible. The Bill prescribes a time limit for initiation of criminal proceedings, arrest, investigation, charge sheet, proceedings before magistrate, cognizance, charges, plea bargaining, appointment of Assistant Public Prosecutor, trial, bail, judgment and punishment, and mercy petition. Bharatiya Sakshya Adhiniyam will have 170 provisions (instead of the original 167 provisions, and a total of 24 provisions have been changed. Two new provisions and six subprovisions have been added and six provisions have been repealed or deleted in the Adhiniyam. The complete implementation of new criminal laws will ensure an end to ‘tareekh pe tareekh’ era and justice will be given in three years as earlier informed in the Parliament by Union Home Minister Amit Shah. This process of reform in the three laws of the criminal justice system was started in 2019 and 3,200 suggestions in this regard were received from various stakeholders. Speaking on the three new laws on June 29, Union Home Minister Amit Shah said that the three laws of the British era that were governing the Indian Judicial system have been changed on the concept of delivering speedy justice. Several legal experts say there are big challenges ahead for law-enforcing agencies, judicial officers, and legal professionals as the new laws come into force. The passing of the three criminal law bills in Parliament last year sparked a series of debates regarding the need to take such steps towards evolution in the field of law with the introduction of new criminal laws. “The way the government rushed to bring these laws in Parliament and the way it implemented rushed to, is not desirable in a democracy. These laws were neither adequately discussed in the Parliament committee nor extensively discussed in the House, even no consultation held with the stakeholders,” former Union Law Minister and Congress leader Ashwini Kumar told ANI. “Now, the opposition parties demanding a change in the legal architecture of HATHRAS STAMPEDE FROM PAGE 1 Adityanath following the tragedy and assured that all necessary help would be provided to the victims. “The Uttar Pradesh government is engaged in providing all possible help to the victims. My condolences to those who have lost their loved ones. I wish for the speedy recovery of the injured,” PM Modi said in a post on X. He reiterated his condolences during his reply to the motion of thanks on the President’s address in Lok Sabha. The Prime Minister said he had received tragic news of people dying in the stampede in Hathras and the administration was engaged in relief and rescue efforts. He said all necessary help will be provided to victims. Leader of Opposition Rahul Gandhi emphasised the need for the government to help people sensitively. “The government should help people sensitively. I offer my condolences to all the families who have lost their loved ones,” Gandhi said. Meanwhile, Samajwadi Party MP Akhilesh Yadav questioned the government’s preparedness, stating, “What was the government doing when such an incident took place?” “We got this information when we were in Parliament. The question is what was the government doing when such an incident took place? So many people have lost their lives. It is sad that if the government knew that there would be a large gathering at an event, what did they do for their safety?” Yadav also said that the government is responsible for this. “Help should be provided to the families of the deceased. I hope that the Govt will ensure the best treatment for the injured...” Yadav added. Why is terrorism inserted as a general penal law offence when it is already punishable under special legislation? Why has police custody been extended from 15 days to 90 days?” he asked. “The three laws were passed in a hurry and at a time when 25% of the members of Lok Sabha were suspended and had no opportunity to participate in the debate. More consultation with various stakeholders would have allowed the Government to rectify some of the deficiencies, which are now becoming a cause of concern,” Former Union Law Secretary PK Malhotra said. Senior Advocate, Supreme Court, NS Nappinai said that the new criminal laws are here to stay and the sooner we adapt to it, the better. “Resistance to change is natural but it can only be assuaged through transparency and effective implementation. For this reason, the shortening of the initial timeline proposed for implementation appears to be a bit of a hasty act. The changes to the procedural aspect in particular needed more time for effective adaptation. One can only hope that an escalated process has been adapted to bring the system to speed,” she said. Taking a step ahead, the Delhi Police on January 17 this year, commenced a focused training program for its officers to adapt to the new criminal laws. “Delhi Police Academy being a training institute of Delhi Police which is an executing authority, has commenced a focused training program for its officers to adapt to the new criminal laws passed by the Parliament of India i.e. According to a notification by the Ministry of Home Affairs, the three laws will replace the Indian Penal Code (IPC), 1860; the Code of Criminal Procedure (CrPC), 1973; and the Indian Evidence Act, 1872. Speaking to ANI, Vinod said, “I did not even know that all three had gone to the Satsang because he had gone somewhere outside. Someone told him that there was a stampede in the satsang after which I reached the spot and found out that my 16-year-old daughter, mother and wife had died. Kamla, the mother of another 16year-old victim of the Hathras tragedy, expressed grief over the death of her daughter Roshni. She said, “I have been coming to Baba’s satsang for 20 years. Today, I went to attend satsang with my 16-year-old daughter and a stampede broke out around 2 in the afternoon. I and my daughter were slightly injured. She was fine but as soon as she reached the hospital, she fell unconscious, later the doctors declared her dead.” Kunwar Pal, uncle of the deceased 3.5-year- old child, said, “The child had come here with his mother...His mother is still missing...We are a resident of Aligarh...” Meanwhile, the husband of the deceased Gudiya Devi, Mehtab said, “I tried to stop her from attending the Baba’s Satsang many times but she did not listen. She had come for the Satsang with our daughter & two neighbouring women. The two neighbouring women and my wife died in the incident...My daughter is safe...” Heera Lal from Aligarh, a family member of a victim, said, “My entire family travelled in a bus to attend Satsang. All his family members are fine except his sister-inlaw who got injured in the stampede.” The stampede occurred at a religious event in Hathras on Tuesday, in which 116 people were killed and 18 people were injured, officials said. Assam Agriculture Minister Atul Bora, MLA Biswajit Phukan and senior officials of the forest department along with officials of the Golaghat district administration were also present. Assam Chief Minister Sarma told media that, the flood waters have inundated 163 forest camps of the national park. “Since last night, the water level has been increasing in Kaziranga National Park. The flood waters submerged around 163 camps. The forest guards are still staying in those camps and they are still doing their jobs. We have vacated 9 camps due to the high level of water. We have brought some restrictions on vehicular movement given the safety and security of wildlife,” said CM Sarma. “A rhino calf died due to a flood and two deers died while crossing the road. NDRF teams are here and mobile veterinary teams are also here. The health department is also working here. We are trying our best to deal with the situation,” he said. Adding further, he said, “While the water level in Dibrugarh, Jorhat, Tinsukia and Subansiri river water level is also decreasing I think that the water level in Kaziranga might be decreased from tomorrow night or the day after tomorrow. Our whole forest team is working day and night.” He further said that the training of the 3rd battalion is almost completed and as many as 1,000 forest staff are ready and if needed will be deployed in Kaziranga. “We have made arrangements to deploy 100 out of the 1,000 forest staff of the 3rd battalion in Kaziranga. We will able to deal with the situation. We also touch with the Karbi Anglong district administration, council and village heads to ensure the safety and security of wild animals in the Karbi Hills as many wild animals moved towards the hills areas,” said the Assam CM. Earlier in the day, the Indian Air Force (IAF) rescued 13 fishermen marooned on a small island in the middle of the Brahmaputra north of Dibrugarh in Assam due to a rise in the water level of the river. Previously personnel of NDRF, SDRF and Inland Water Transport boats had attempted to rescue the fishermen who had been stranded in the middle of the Brahmaputra since Friday. The rising water level and extreme current of the river prevented the rescue efforts, Assam State Disaster Management Authority (ASDMA) said. The flood situation in Kaziranga National Park in Assam has turned critical as the flood waters earlier inundated 95 forest camps. There are a total of 233 camps in the park. As a result of the flooding, the authorities have vacated six camps. Sonali Ghosh, Field Director of Kaziranga National Park, said that a wooden bridge near the Moshguli Camp in Agoratoli Range was washed away by floodwaters on Monday, July 1. “Herds of elephants have started moving towards Karbi Anglong through the Hati Dandi corridor. Heavy traffic diversion has been requested for the NH 715 stretch under Nagaon and Golaghat districts. Section 144 of the Code of Criminal Procedure (CrPC) has also been issued,” Ghosh said. On Monday the ASDMA said that 19 districts- Kamrup, Golaghat, Majuli, Lakhimpur, Karimganj, Cachar, Dhemaji, Morigaon, Udalguri, Dibrugarh, Tinsukia, Nagaon, Sivasagar, Darrang, Nalbari, Sonitpur, Tamulpur, Biswanath, Jorhat- were affected by the floods. It said that all the rivers flowing through the state had crossed the danger mark at several places. Meanwhile, Prime Minister Narendra Modi, during a telephone conversation, assured Assam Chief Minister Himanta Biswa Sarma of full cooperation from the Centre in tackling the flood situation in the state. Chief Minister Himanta Biswa Sarma said he had briefed the Prime Minister about the relief measures being taken by the State. “Hon’ble Prime Minister Shri @narendramodi Ji called me a short while ago to enquire about the flood situation in Assam. I explained to him that Assam is experiencing a second wave of floods this year due to heavy rains in Arunachal Pradesh and part of our upper Assam districts. I also briefed him about the relief measures undertaken by the state government,” Sarma said in a post on X on Monday, June 1. “He assured me of full cooperation from the Government of India in this hour of crisis,” he added. Assam Transport Minister Keshab Mahanta on Tuesday visited the Hatimura area under Kaliabor Sub-Division in Nagaon district where the flood waters washed away a portion of an embankment near the sluice gate.
